Bennett Thrasher shareholder Peter Stathopoulos was quoted in the article “New Georgia Tax Court Set to Launch Jan. 1,” published in the Atlanta Business Chronicle on Dec. 7, 2012. Starting Jan. 1, 2013, the state law establishing a new court specializing in tax litigation will take effect. The new tribunal, headed by a judge with at least eight years of experience in tax law will speed up decisions on tax appeals that are typically considered low priority compared to other cases taking up Superior Court dockets. Peter explained that this new court will allow Georgia to do away with what has been a “pay-to-play” system of adjudicating tax appeals in Superior Courts. The legislation creating the court also includes a provision aimed at streamlining the discovery process, which can be very laborious and time-consuming. Overall, taxpayers will be able to save money by pursuing appeals through small claims because they will not have to hire a lawyer; they can represent themselves or bring their CPAs.
